Today, lawmakers are expected to begin debate on Senate Bill 1. SB1, sponsored by Sen. Scott Rupp, would reform Missouri’s Second Injury Fund and bring occupational disease back under Missouri’s workers’ compensation system.
The insolvency of the Second Injury Fund poses a very real threat to employers around the state. As the issue goes before the Missouri Supreme Court, it is likely that a tax increase will be assessed upon Missouri employers to return the fund to solvency, without any reforms that bankrupted the fund in the first place. SB 1 would address this problem and keep the decision out of the courts.
SB 1 has also been amended to address recent court interpretations of Missouri’s workers’ compensation system that has taken occupational disease out of Missouri’s workers’ compensation system. This makes Missouri one of the only states that treats occupational disease in this manner and is a threat to both Missouri workers and employees.
